The recent cyberattack on the computer system of the International Criminal Court (ICC), responsible for prosecuting war crimes and crimes against humanity worldwide, has deeply shaken the legal sector. According to the statement, the International Criminal Court detected unusual activity on its computer network and mentioned that efforts are ongoing regarding the measures taken against the attack. The court spokesperson refrained from commenting on the severity and details of the attack but stated that urgent measures have been taken to intervene and mitigate the impacts of this cybersecurity incident. The court did not specify which part of its system was breached.

The ICC, an institution tasked with prosecuting war crimes and crimes against humanity worldwide, houses sensitive documents ranging from criminal evidence to protected witness names. The Dutch government announced its continued assistance to the court in analyzing and mitigating the effects of this incident, as well as taking steps to enhance cybersecurity. The country's National Cyber Security Center is also supporting the investigation.

The International Criminal Court attack could undermine confidence in international criminal law and justice

Attorney Görkem Gökçe, Founding Partner of Gökçe Law Firm, made the following assessments regarding the cyberattack on the International Criminal Court (ICC): 'The cyberattack on the International Criminal Court (ICC) is a significant cause for concern in the context of global law and international relations. Any attack on the functioning and security of this court, which is tasked with prosecuting war crimes and crimes against humanity worldwide, can erode confidence in international criminal law and justice. Although the nature and severity of the attack have not yet been fully understood, the urgent measures taken by the court and the analysis efforts aided by the Dutch government reflect an attempt to mitigate the gravity and potential impacts of the incident. However, it should be noted that such a cyberattack could potentially harm the sensitive information contained within the court and affect its ongoing investigations.'

Collaboration is imperative in the international fight against cybersecurity threats

The Dutch intelligence agency (AIVD) stated in its annual report for 2022 that the ICC has attracted Russia's interest and that the court is investigating potential Russian war crimes in Georgia and Ukraine. AIVD had previously announced the detection of a Russian military agent attempting to infiltrate the court in June. ICC Prosecutor Karim Khan also stated in August 2023 that cyberattacks could become part of future war crimes investigations. This incident underscores the necessity for stronger cooperation and measures in the international battle against cybersecurity threats.

Attorney Görkem Gökçe continued with his statement on the potential impacts of this attack on the legal system: 'This incident also highlights the challenges and dangers related to cybersecurity for international institutions. The exposure of a significant institution like the ICC to such attacks can be seen as a call for the international community to enhance cybersecurity measures and address the shortcomings of international law in the digital realm. Such events once again emphasize the importance of taking determined steps to bolster cybersecurity and prevent any threats that may harm international justice.
